This Privacy Policy explains how Justin Bermingham ("we", "I", "us") collects, uses, and protects information you share when you visit justinbermingham.com or submit a contact form. We respect your privacy. We don't sell your data.
1. What we collect
When you submit a form on this site (for example the "Let's Talk" form or the contact form), we collect :
- Your name
- Your phone number
- Your email address
- Any information you voluntarily include in the message field (e.g. loan purpose, timeline, questions)
- Your IP address + basic device metadata (collected automatically by standard web-server logging)
2. How we use it
We use the information you provide to :
- Respond to your inquiry (call, text, or email you back)
- Pre-qualify you for mortgage, HELOC, VA, DSCR, construction, or commercial lending products offered through E Mortgage Capital, Inc. (NMLS# 1416824)
- Send you relevant market information or rate updates, if you consent
- Keep records required by federal + state lending regulations

4. Who we share it with
We share the information you submit with :
- E Mortgage Capital, Inc. — the lender of record where I am a licensed Loan Officer (NMLS# 1416824). This is required to process a loan application.
- Service providers we use to deliver messages, store data, and secure our systems (examples : Twilio for SMS, Google Workspace for email, Azure for data storage). These providers process data on our behalf under confidentiality obligations.
- Government agencies or investors when required by law, by subpoena, or to complete a loan transaction you requested.
We do not sell your personal information.
5. Your rights (California residents)
If you are a California resident, the California Consumer Privacy Act (CCPA) + California Privacy Rights Act (CPRA) give you the following rights :
- Right to know. You can ask what personal information we have collected about you.
- Right to delete. You can ask us to delete personal information we collected from you (subject to legal record-keeping requirements).
- Right to correct. You can ask us to correct inaccurate personal information.
- Right to opt out of sale or sharing. We do not sell or share your personal information for cross-context behavioral advertising. If this ever changes, you will be able to opt out here.
- Right to non-discrimination. We won't treat you differently for exercising any of these rights.
To exercise any of these rights, email [email protected] with "Privacy Request" in the subject line. We will verify your identity before responding, and reply within 45 days.
6. Your rights (other U.S. states)
If you are a resident of a state with a comprehensive privacy law (Virginia, Colorado, Connecticut, Utah, and others), you have similar rights to the California rights listed above. The exercise process is the same — email the address listed.
7. Marketing emails (CAN-SPAM)
Every marketing email we send includes an unsubscribe link. Click it and we remove you from marketing lists within 10 business days. Transactional emails related to an active loan application are not marketing and continue until the transaction completes.
8. Data retention
We retain your personal information for as long as reasonably necessary for the purposes described above, or as long as required by federal + state lending record-keeping rules (typically 3-7 years for loan-related records). After that, we delete or anonymize.
9. Security
We use reasonable administrative, technical, and physical safeguards to protect your information. No system is 100% secure. If we ever discover a breach affecting your information, we will notify you as required by law.
10. Cookies + analytics
This site uses a minimal set of cookies for basic functionality + anonymous analytics (page views, traffic sources). We do not use cross-site tracking cookies. You can disable cookies in your browser settings without affecting the site's core functionality.
11. Children
This site is not directed at children under 13. We do not knowingly collect information from children. If you believe we have collected information from a child, email us and we will delete it.
12. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top reflects the most recent change. Significant changes will be highlighted on the home page for 30 days.
